Terms and Conditions (T&Cs)
1. Scope
1.1. These Terms and Conditions (T&Cs) govern all deliveries, services, and offers provided by us, Mortclothing, through our online shop.
1.2. Customer conditions that deviate from these T&Cs are not accepted unless explicitly agreed to by us in writing.
1.3. These T&Cs apply to all contracts concluded via our online shop between us and our customers, whether consumers or business customers.
2. Conclusion of Contract
2.1. The product presentations in our online shop are non-binding and serve as an invitation for customers to submit a purchase offer.
2.2. The customer submits a binding purchase offer by placing items in the shopping cart and clicking the "Buy Now" button.
2.3. Upon receipt of the order, we send an acknowledgment of receipt. This acknowledgment does not yet constitute acceptance of the purchase offer. A purchase contract is concluded only when we confirm the order via email or ship the goods.
2.4. We reserve the right to review orders for fraud, payment validity, and stock availability. Orders may be rejected within 14 calendar days without stating reasons.
3. Prices and Shipping Costs
3.1. All prices listed in the online shop include statutory VAT.
3.2. Packaging costs are included in the prices. Shipping costs are displayed separately and are borne by the customer. Details are available on our "Shipping" page.
3.3. For international deliveries, additional fees (e.g., customs duties) may apply, which are the responsibility of the customer.
4. Delivery
4.1. Delivery dates and times are non-binding unless explicitly agreed otherwise in writing.
4.2. Delivery delays due to force majeure or unforeseen events beyond our control (e.g., strikes, natural disasters, supply shortages) entitle us to postpone delivery or withdraw from the contract.
4.3. If goods are unavailable, we will notify the customer immediately and refund any payments already made.
4.4. If delivery fails after three attempts due to reasons attributable to the customer (e.g., incorrect address or failure to accept the delivery), we reserve the right to retain shipping costs and seek compensation for damages up to the purchase price.
5. Right of Withdrawal
Customers have the right to cancel their order within 14 days. For more information, see our Withdrawal Policy, which is part of these T&Cs.
6. Warranty and Liability for Defects
6.1. Customers have statutory warranty rights (valid for 2 years from the date of delivery).
6.2. In the event of defects, customers are entitled to repair or replacement. If this fails, customers may reduce the purchase price or withdraw from the contract.
6.3. If a defect is found not to be covered by warranty (e.g., due to improper use or unauthorized modifications), we reserve the right to charge inspection and shipping fees.
7. Retention of Title
7.1. The goods remain our property until full payment has been received.
7.2. In the event of suspected fraud or misuse, we reserve the right to cancel the transaction and retain ownership of the goods until the matter is resolved.
8. Payment Terms
8.1. Payment methods are listed on our website under "Payment Options."
8.2. For prepayment methods, payment must be received within 10 days.
8.3. In the event of default, we charge interest of 5 percentage points above the base rate and a €10.00 processing fee for returned payments due to insufficient funds.
8.4. Orders flagged for potential fraud may require additional identity verification. We reserve the right to cancel the order if verification fails.
9. Fraud Prevention and Liability
9.1. We actively monitor and investigate transactions to prevent fraud. Suspicious activities (e.g., stolen payment details, fake addresses) may result in order cancellation and notification to relevant authorities.
9.2. Customers are responsible for ensuring accurate and truthful information during the ordering process. Providing false information may lead to legal consequences.
9.3. Our liability is limited to damages caused by intentional or grossly negligent actions. For slight negligence, liability applies only to breaches of essential contractual obligations and is limited to foreseeable damages.
9.4. These limitations do not apply to claims under product liability law or for damages resulting from injury to life, body, or health.
10. Jurisdiction and Applicable Law
10.1. These T&Cs are governed by German law.
10.2. The place of jurisdiction is Dortmund, provided the customer is a merchant as defined by the German Commercial Code (HGB) or does not have a general jurisdiction in Germany.
11. Changes to the T&Cs
We reserve the right to amend these T&Cs at any time with future effect. The current version will always be available on our website. Customers are advised to review the T&Cs regularly.
